Frequently Asked Questions

Is there a time limit for the police to investigate a sexual allegation?

There is no time bar on the charges of this nature being brought against you.

Is there a penalty for a sexual offence?

In 2014 the Sentencing Council introduced guidelines for all sexual offences and sentences broadly speaking have been increased to impose tougher punishments. Offences range in seriousness, with some being dealt with in the Magistrates and others being too serious and thereby being tried in the Crown Court. The more serious offences such as rape and assault by penetration can attract a maximum of life imprisonment.

Those convicted may also be required to sign the Sex Offenders Register and may also be subject to a Sexual Offenders Prevention Order.

What classifies as a sexual offence?

Under the umbrella of sexual abuse, there are five categories of sexual offences:

  1. Rape and Sexual Assault – penetration without consent, and coercion or physically forcing someone to engage, or touching someone sexually against their will
  2. Child Sexual Abuse – applies to anybody under 18 and includes grooming, physical contact and non-physical, inappropriate activity.
  3. Prostitution – the CPS focuses predominantly on charging those causing or controlling prostitution for gain or exploitation through trafficking.
  4. Pornography – including ‘revenge porn’ disclosed without consent, indecent images of children, and extreme pornography which is obscene and extreme including violence, mutilation or that including animals.
  5. Indecent Images – sexual images of a child under 18, including pictures of nude or partially note children involved in any kind of sexual activity.
