Concerns that may trigger NMC investigation

The scope of concerns that may lead to an investigation by the Nursing and Midwifery Council can span both misconduct and health-related matters.

When considering the ‘fitness to practise’ of a midwife, nurse or nursing associate, the following could all lead to further investigation, and will all be considered in the context of the ability to do one’s job and keep patients safe:

  • Misconduct of any kind
  • Incompetence in the role
  • Health concerns
  • Criminal cautions or convictions (very dependent on the nature of these)
  • Determination by other Health & Social Care organisations and investigations
  • Not having the necessary knowledge of English language to communicate with colleagues and patients

Due to the vast array of evidence that could require collecting and examining, the investigation is likely to be the longest stage of the process. They will need to gain a complete view of the context and individual, find any CCTV footage or medical records and speak with the complainant and any other witnesses.
