What makes a Sharia Compliant Will?
There are three key elements of the will writing process to consider.
Firstly, you must account for the cost of burial and payment of any debts.
The balance of your estate is then split into thirds.
Two thirds of the estate will be distributed amongst designated heirs.
The final third, (‘bequest’) can be utilised however you wish. This could be giving to charity, Sadaqah Jariyah, or supporting organisations or people who wouldn’t otherwise be in receipt of inheritance.
You should be specific as possible in your wishes, i.e. ‘1/3 of my assets left to charity X’.
Important Elements of Sharia Law Distribution and reasoning :
- Males have responsibility to upkeep the financial stability of the family. Because of this, sons are entitled to double the share of daughters
- Males must utilise their extra share to support females, whilst females can use their inheritance for themselves, however they wish
- Shares to parents are equal
- Where a relative is a non-believer, they are not entitled to inherit under Sharia Law
When meeting with a solicitor, you should consider:
- Wishes for your funeral
- What will be left to whom
- Who will be named executor(s) of your Will
- Do you need to appoint guardians for your children?
- What is the value of your assets?
- If you have a business, what will happen to that if you die?
- The individual(s) appointed as executors of the will must be Muslim
