Buying a rental property is a bigger legal undertaking than buying a home to live in, as there are different mortgage rules, extra stamp duty, and landlord obligations that start the moment you complete. Our buy to let solicitors handle the conveyancing from offer to completion, so your investment is legally sound from day one. We act for landlords across Manchester, Sale, and Chester, and for portfolio landlords throughout the North West.

What is buy to let conveyancing?
Buy to let conveyancing is the legal process of buying or selling a property intended for rental rather than for you to live in. It covers the same core stages as standard conveyancing — searches, contracts, and completion — plus landlord-specific checks: buy to let mortgage terms, the 5% Stamp Duty Land Tax surcharge, and any letting restrictions in the title.
Buy to let conveyancing services we can help with
Buy to let purchases
A buy to let purchase involves the same conveyancing steps as buying a home to live in, but with landlord-specific checks built in. Our buy to let conveyancing solicitors review the title for letting restrictions, check your mortgage offer against the purchase terms, and calculate the SDLT surcharge before you exchange, so there are no surprises at completion.
Buy to let mortgages and remortgaging
A buy to let mortgage is assessed against projected rental income rather than your personal salary, and the legal work reflects that. We liaise directly with your lender, review the mortgage offer alongside the purchase contract, and handle remortgages when you’re refinancing an existing rental property or releasing equity to expand your portfolio.
Portfolio and limited company purchases
Many landlords choose to hold buy to let property through a limited company for tax reasons, since companies can still deduct mortgage interest in full rather than being restricted to the 20% tax credit that applies to individual landlords under Section 24. We can act on purchases in a company name and advise on the conveyancing implications of structuring a portfolio this way.
Selling a buy to let property
Selling a tenanted or vacant rental property brings its own considerations, from giving tenants the correct notice to handling any outstanding deposit obligations before completion. Our team manages the sale conveyancing end to end, working around tenancies in place where needed.
Lease and title reviews
Before you commit to a purchase, we check the title and any lease for letting restrictions, superior landlord consents, or clauses that could limit how the property can be rented out. This is particularly important for leasehold flats, which are common among buy to let purchases in Manchester, Sale, and Chester.
How the buy to let conveyancing process works
- Instructing us and initial checks
We take your instructions, carry out identity and anti-money laundering checks, and request the draft contract and title documents from the seller’s solicitor. If you already have a mortgage offer in principle, send this across now so we can start reviewing the lender’s requirements alongside the purchase.
- Searches and mortgage review
We order local authority, environmental, and water searches, and review your buy to let mortgage offer in detail, checking the lender’s conditions against the purchase terms. This is also when we check the title for any letting restrictions — something many landlords don’t think to ask about until it’s too late, so we flag it early rather than at exchange.
- Raising enquiries and reviewing the contract
We raise enquiries with the seller’s solicitor on anything the searches or title raise, and review the contract to make sure it reflects what you’ve agreed. For leasehold buy to let properties, we also check the lease terms for any subletting restrictions or consent requirements from the freeholder.
- Exchange of contracts
Once enquiries are resolved and your mortgage funds are confirmed, we exchange contracts and agree a completion date. At this point the transaction becomes legally binding, and we’ll calculate the exact SDLT surcharge due so you know the final figure before completion.
- Completion
We transfer funds, complete the purchase, and register you as the new owner with the Land Registry. If the property is already tenanted, we’ll also confirm the tenancy details transfer correctly so rent collection continues without a gap.
- After completion
We submit your SDLT return and pay any tax due within the 14-day deadline, and can advise on next steps as a landlord: from deposit protection to your obligations under the Renters’ Rights Act 2025.
