Who Is Eligible for a UK Spouse Visa?
To be eligible for a UK spouse visa, you and your partner must meet certain requirements, including:
- You must have settled status in the UK – This means you are a British citizen, have Indefinite Leave to Remain, or have refugee status.
- You must meet the financial requirement – You must earn at least £29,000 per year or have sufficient savings to support your partner. If you have children, the income threshold increases. (This increase was implemented on the 11 April 2024. However if you applied before 11 April 2024, you will only need to meet the previous £18,600 income threshold).
- Your partner must meet the English language requirement – They can prove this by passing an approved English test or by having a degree taught in English.
- You must be in a genuine relationship – You will need to provide evidence that your relationship is legitimate.
- You must have adequate accommodation – If you are renting, you will need written permission from your landlord confirming that you and your partner can live in the property.

Spouse Visa Application Process
If your partner is applying from outside the UK, they must complete an online application and attend a biometric appointment in their home country. Applications typically take up to 12 weeks, although some countries offer a fast-track service with a decision in as little as five working days.
If your partner is already in the UK on a different visa, they may be able to switch to a spouse visa without leaving the country. Our immigration team can assess your circumstances and advise on the best approach.
Once approved, the visa will be granted for an initial period of 33 months (or 30 months if applying from within the UK). Before it expires, your partner must apply for an extension. After five years of continuous residence in the UK, they can apply for Indefinite Leave to Remain.
