Why do you need a lawyer to help you write a will?

It’s generally advisable to get a solicitor involved in writing your will, as their expertise will help guarantee that your wishes are legally enforceable and fully understood. It’s surprisingly easy to make mistakes with writing a will, and even tiny mistakes can end up having big consequences – simple errors like vague wording, incorrect witnessing, or unaccounted-for assets can cause major issues like delays, disputes or unintended tax consequences.

What’s more, before we begin drafting your will, our team at Slater Heelis will sit down with you to talk through your personal and financial situation, and make sure we understand exactly what you want to achieve. That enables us to provide precise legal drafting and eliminate any risk of uncertainty, so you have complete confidence in the final document. We can also help you avoid potential pitfalls that could create confusion or leave parts of your estate vulnerable to challenge.

Frequently Asked Questions about writing a will

Do I have to list every single asset in my will?

You don’t need to list every individual asset in your will, especially since specific details about smaller items or assets may be subject to change. Instead, many people choose to clearly outline major assets such as property, significant investments, or valuable personal items separately, and then include a general provision covering the remainder of their estate. This approach ensures your beneficiaries still inherit everything you intend, without the requirement to continuously update your will for minor changes.

Does my spouse automatically inherit my estate?

No. Your spouse does not automatically inherit your entire estate unless you specifically state this intention within a legally valid will. If you die without making a will, your estate will be distributed according to the rules of intestacy, which may not fully align with your wishes or expectations. Under these rules, your spouse may receive a significant portion of your estate, but other relatives or dependents might also be entitled to inherit.

Can I update my will after it’s been written?

Yes – you can update your will at any point after it has been created, provided you retain full mental capacity. It’s generally advisable to regularly review and update your will, especially after significant life events such as marriage, divorce, having children, purchasing property, or receiving an inheritance. Keeping your will updated ensures your current circumstances and intentions are accurately reflected.

You can make updates either by preparing an entirely new will, or by using a supplementary legal document called a codicil. Codicils are suited to minor amendments such as changing executors or updating beneficiary details. However, for major changes, we’d normally recommend a new will to clearly revoke any previous versions and avoid confusion or disputes. If you like, our solicitors at Slater Heelis can provide guidance on the best method for your particular situation.
