What is unfair dismissal?
Unjust dismissal occurs when your employer ends your employment in a way that breaches employment law. To be classed as unjust, the reason for dismissal must not be lawful, or the process your employer followed must have been unreasonable or improper.
Typical examples include:
- Being dismissed without proper warning or disciplinary procedure
- Losing your job because of discrimination or for asserting a statutory right
- Being dismissed for reasons unrelated to your conduct, capability, or role
- Being replaced after redundancy procedures were mishandled or misused
In most cases, you’ll need to have worked for your employer for at least two years to qualify for protection under dismissal law, although there are exceptions, such as dismissals linked to discrimination, whistleblowing, or health and safety concerns.
When can I make an unfair dismissal claim in Sale?
You can make a dismissal claim if you believe your employer didn’t have a lawful reason to dismiss you or failed to follow a reasonable process. Employment law recognises five potentially lawful reasons for dismissal: conduct, capability, redundancy, statutory restriction, and some other substantial reason. Even where one of these applies, your employer must still act reasonably and follow the correct procedure before making their decision.
Many claims arise when the disciplinary or performance process hasn’t been properly managed, or when redundancies are handled carelessly, and selection criteria are applied inconsistently. Some people are dismissed after raising legitimate concerns about misconduct or health and safety, or after exercising statutory rights such as requesting flexible working or taking family leave. In other cases, employees resign because conditions at work have become intolerable, leading to what’s known as constructive dismissal.
If any of these situations sound familiar, our employment solicitors in Sale can review what’s happened, explain whether your case meets the legal definition of unjust dismissal, and help you decide whether negotiation, settlement, or a formal tribunal claim would be the most effective route forward.
