Witnessing Wills in Lockdown

April 17, 2020, By

There has been a significant increase in the number of people wanting to arrange their wills whilst we are in lockdown, understandably as we are worried about the health of our loved ones and ourselves.

We would like to reassure you that there are still ways in which your Will can be witnessed, in line with social distancing guidelines and we are assisting client in finalising their Wills and will continue to do so throughout this difficult time.

Once we have drafted your Will, our dedicated team of lawyers will guide you and your witnesses through the act of witnessing the Will.

If you would like to talk to one of our team to prepare a new Will or update an existing Will please call us on 0161 969 3131.

How to Witness a Will in Isolation

Whether you are suffering from COVID-19, are self-isolating due to risk of infection, or simply following the Government guidance for staying at home, there is still a way to get your Will completed legally.

If both your witnesses are well and willing to do so, it is acceptable for your signature to be witnessed through glass doors or a window. We will talk you through every stage of the witnessing process to ensure that the legal formalities are complied with.

Solicitors Guidance on Witnessing Wills

Our top priority is the health of our clients and colleagues in these difficult circumstances. Our offices are closed, but all of our Wills, Trusts & Probate team are available on the phone to answer any questions you may have and guide you through the process to the completion of the Will.

We will give clear guidance to you and can even stay on the phone with you at the time of witnessing.

All of our staff are here to help, and we will do what we can to ensure that your Will is witnessed legally, albeit in a slightly unconventional manner.

What about Lasting Power of Attorney?

The Lasting Power of Attorney (LPA) certificate provider does not have to be physically present when the deed is signed therefore we can still assist you in the preparation of LPA’s and act as your Certificate Provider despite being in lockdown.

Video meetings are recommended for LPA signings as it is easy to check that nobody else is present and there are a multitude of video conferencing programs freely available.

Here to Help

Email the team or call us on 0161 969 3131 and we will do our best to advise you in relation to the latest guidelines.

We would also like to remind you that due to the increase in interest of will writing, there appear to be many ‘cheap, quick fix’ providers surfacing who may be trying to take advantage of our uncertainties. Make sure you fully research any company you use for important services in this time.
