Was your toxicology test reliable?

December 4, 2017, By

Many will be aware of the recently reported allegations of data manipulation in criminal proceedings where toxicology testing has been used[1].

The allegations relate to testing carried out to detect the presence of drugs or alcohol in hair, blood or urine at Manchester’s Randox Testing Services and Trimega Laboratories since 2010.

The Ministry of Justice has not yet confirmed that civil proceedings have been directly affected, however the allegations have justifiably led to concerns being raised about the quality of, and reliance placed upon, this type of evidence in civil matters where testing has been used.

If you have been involved in private law proceedings regarding the arrangements for children where decisions have been based on such testing you will undoubtedly have concerns about the outcome of your case.

Guidance on the processes which have been put in place by the Ministry of Justice to assist those who may have such concerns can be found at https://www.gov.uk/guidance/forensic-toxicology-tests
